The Potential Risk Exposure for the HVAC Company — Rick, an employee and driver with Acme HVAC LLC takes his eye off the road for just one moment and runs into the back of a minivan damaging the van and causing $20,000 in property damages + 2 of the passengers in that van are injured resulting in $50,000 in payouts for Bodily Injury.

Rick is not injured himself but his work partner Tony, who also works for Acme HVAC LLC is injured.

In this instance the commercial auto policy insuring Acme HVAC LLC will pay for the damages to the van Rick hit, plus the injury claims to the two passengers in the van.

The commercial auto policy will not pay for the injuries to Tony because Tony is an employee of Acme HVAC LLC and is not eligible to be compensated by the commercial auto policy for his injuries. (This would be covered by workers compensation)

So, in this instance, the damage to the minivan and the injuries to those in the minivan are covered by Rick’s employers commercial auto policy, the injuries to Ricks fellow employee are not covered.
